HAGERSTOWN – The City of Hagerstown has taken formal steps to regulate the location of cannabis-related businesses. At its May 27 regular session, the City Council voted to amend its zoning code, adding specific provisions to manage the location of dispensaries and other cannabis enterprises.
The ordinance updates Chapter 140 of the city’s Land Management Code and introduces changes to align local law with Maryland’s expanding cannabis regulations while protecting neighborhood integrity and public safety.
Why local regulation was needed
Under current state law, cannabis is legal for both medical and adult use. Without local action, municipalities risk defaulting to statewide rules that may allow dispensaries in any commercially zoned area, even if those locations are near schools, parks or residential zones.
Council members emphasized that the ordinance does not block cannabis businesses from operating in Hagerstown. Instead, it sets guardrails to ensure thoughtful placement and oversight.
Key changes in the ordinance
The new zoning update affects Article 3 (definitions) and Article 4, Section Z (chart of permitted and special exception uses) in the city’s Land Management Code. Highlights include:
- New definitions for cannabis-related uses, including dispensaries, processors and growers
- Zoning restrictions that limit these businesses to designated districts
- Special exception requirements in specific areas to ensure public input
- Safeguards to prevent clustering or inappropriate siting near schools and residential neighborhoods
Planning officials said the changes will support business development while preserving the quality of life in surrounding communities.

Planning and code administration staff members will use the updated ordinance to review new business applications immediately.
